John Hay was the son of Thomas Hay, 7th Earl of Kinnoull and Elizabeth Drummond.2 A contract for the marriage of John Hay and Marjory Murray was signed on 2 June 1715.1 He died on 24 September 1740, without issue.1
In 1715 he was a Jacobite.1 In 1716 he was attainted.1 He was created 1st Earl of Inverness [Jacobite] on 5 October 1718.1 He was Acting Jacobite Secretary of State between 1724 and 1727.1 He was created 1st Baron Hay [Jacobite] on 3 April 1727.1 He was created 1st Duke of Inverness [Jacobite] on 4 April 1727.1 He lived at Cromlix, Scotland.1
